Suppose it depends what way you look at it but it is in the end based on tempest and it is stil owned by atari so he is screwed shame as i love the yaks games
 
I guess ownership has changed hands several times over the years, and I guess some where OK with it, and others where not. I've read in other threads how Atari wants to resurrect their old games for a new generation, so they want to have control currently. Sadly, Jeff has done more for Tempest than anyone else at Atari ever could. 

It seems like sour grapes to me, as they see him doing great with the franchise, and now after not touching it for 30+ years, they want to be dicks about it now, and cause issues. Where was this legal mumbo jumbo when it released on the Vita? Why wait until this guy has done tons of work(PS4, PC, etc.), to now say we don't want you to play with this game anymore. Complete BS if you ask me, as now Tempest will go back in to obscurity to die another slow painful death at the hands of Atari.
