If you ask the person who made them, they probably wont mind...
I think they have been made by Nintendo, and I think they would mind ;)

Those are just sprites, It would be better to just use the Super Mario War engine and modify it so there is a SSB-like gamaetype on the same levels with marios, luigis, toads, princess peaches, bowsers and other nintendo characters. Or if your afraid of Nintendo shuting down your progress, you could make sprites that are in the same style as SMW but original characters that can all have custom colors.

Those sprites were ripped by "ZinDinTimeYUM". Made is something completely different.
From the site itself: "The sprites themselves are, of course, the legal property of the companies that had them created in the first place, but the sheets contain data beyond this."

I'd like to use Kimchiman in the game, cause he could so kick marios ass. I wonder if you could build this game off of the Jump n' Bump engine, cause someones already made that for gp32.

So technically some1 cud go ahead with this and not get done over by the long arms of the law!!!
No, the copyright still belongs to Nintendo but because the person that created the spritesheet took time ripping the sprites and putting them on one sheet he claims a copyright on that.
Not saying you will get into trouble but if you, as suggested, would ask the person that made them (a graphics artist working for Nintendo) he/she/Nintendo would most probably mind.

Hmmm....
it wud be ineteresting to see who's up for taking up the challenge, it's one of those itmes that i wish i cud do it myself, but sadly i don't have the expertize, but if some1 that does is interested please let evry1 know wot u plan on doing.

I think nintendo could care less about a freeware homebrew game on an unheard of console, they have enough problems with piracy

heck, if this was a side scroller, I wouldnt mind, cause thats just about what SSB is, a 3d, but still, side scroller
