I recently got done for torrents, issued a C&D and all that jazz. Can one get tracked down in the same way for using rapidshare?

No.
But eventually the RIAA/MPAA etc.. will go after rapidshare and etc for IP logs and so on.

Torrent sites are still better than most other things. Although usenet is faster. Rapidshare is run by n00bs.

No, it uses a proprietary protocol called FastTrack. Hence it is the only client for that protocol, and is also full of spyware. Yay!
